Terms of Service

This is a general template and should be reviewed by legal counsel before launch.

These Terms of Service ("Terms") are a legal agreement between you and Yaar Khata ("Yaar Khata", "we", "us" or "our") governing your access to and use of the Yaar Khata mobile application, website at yaarkhata.com, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Yaar Khata is a tool that helps groups of people record shared expenses, split costs, track balances and settle up. It is a record-keeping and calculation tool only. Yaar Khata does not hold, transfer, or move money between users; any actual payments between members happen outside the Service, and the balances and suggested payments we show are informational calculations based on the data you enter.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract, to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate account information and keep it up to date.
• Notify us promptly at support@yaarkhata.com if you suspect unauthorised use of your account.

4. Subscriptions, billing & trials

The Service offers a free plan and paid "Pro" subscription plans. By subscribing to a paid plan you agree to the following:

• Billing. Paid plans are billed in advance through our payment processor, Stripe, in Rs / PKR, on a recurring basis (monthly or yearly) until cancelled.
• Free trial. Pro Monthly may include a 7-day free trial. Unless you cancel before the trial ends, your subscription will begin and the applicable fee will be charged.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled beforehand.
• Cancellation. You may cancel at any time from within the app. Cancellation stops future charges; you retain paid access until the end of the current billing period.
• Price changes. We may change plan prices; we will give reasonable notice, and changes apply to subsequent billing periods.
• Refunds. Refunds are governed by our Refund & Cancellation Policy.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent or harmful purpose, including money laundering or misrepresenting financial information.
• Upload content that is illegal, infringing, abusive, or that violates the privacy or rights of others.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service, including via automated scraping, reverse engineering or overloading our infrastructure.
• Add other people to groups or enter their information without a proper basis to do so.

We may suspend or terminate accounts that violate these Terms.

6. Your content

You retain ownership of the data and content you submit (such as expense details and receipt photos). You grant Yaar Khata a limited licence to host, store, process and display that content solely to operate and improve the Service and to make it available to the relevant group members. You are responsible for ensuring you have the right to submit the content you upload.

7. Intellectual property

The Service, including its software, design, "Fresh Mint" branding, logos and content (excluding your own content), is owned by Yaar Khata and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works from the Service except as permitted by law.

8. Third-party services

The Service relies on third parties, including Stripe for payments and infrastructure and analytics providers. Your use of those services may be subject to their own terms and policies. We are not responsible for the acts or omissions of third parties.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that balance calculations will be free of mistakes arising from the data entered. You are responsible for verifying amounts before making real-world payments.

10. Limitation of liability

To the maximum extent permitted by law, Yaar Khata and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or amounts owed between users, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim, or Rs 5,000, whichever is greater.

11. Indemnity

You agree to indemnify and hold harmless Yaar Khata from any claims, damages, liabilities and expenses arising out of your use of the Service, your content, or your breach of these Terms.

12. Termination

You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate your access if you breach these Terms or where required to protect the Service or other users. Provisions that by their nature should survive termination will do so.

13. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the competent courts of Pakistan, unless applicable law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
